PeakForms ("we", "our", or "us") is operated by Peak Dynamics ERP, LLC. We are committed to protecting the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the PeakForms mobile application and web platform (collectively, the "Service").

2. Information We Collect

We may collect the following types of information:

  • Account Information: Name, email address, phone number, employee ID, and role when your organization administrator creates your account.
  • Form Submissions: Data you enter into digital forms including work descriptions, inspection checklists, dates, job numbers, and any notes or comments.
  • Photos and Signatures: Images captured through the app for form documentation, and digital signatures for sign-off.
  • Location Data: GPS coordinates captured at the time of form submission to verify field presence. This is only collected when you submit a form.
  • Device Information: Device type, operating system version, and app version for troubleshooting and compatibility.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service
  • Process and store form submissions for your organization
  • Sync data between your device and your organization's cloud account
  • Enable your organization's administrators to review and approve submissions
  • Improve the Service and develop new features
  • Communicate with you about your account or the Service

4. Data Storage and Security

Your data is stored securely using Supabase, a SOC 2 Type II compliant cloud platform hosted on Amazon Web Services (AWS). Data is encrypted in transit using TLS and at rest using AES-256 encryption. The app stores data locally on your device for offline access, which is synced to the cloud when connectivity is available.

5. Data Sharing

We do not sell, trade, or rent your personal information to third parties. We may share data with:

  • Your Organization: Administrators and supervisors within your organization can view submissions, employee data, and reports as part of normal business operations.
  • Service Providers: We use third-party services (cloud hosting, analytics) that may process data on our behalf under strict contractual obligations.
  • Legal Requirements: We may disclose information if required by law, regulation, or legal process.

6. Data Retention

We retain your data for as long as your organization maintains an active account with PeakForms. Form submissions and associated records are retained for a minimum of 7 years to comply with industry record-keeping requirements. Upon account termination, data may be retained for up to 90 days before permanent deletion.

7. Your Rights

Depending on your jurisdiction, you may have the right to:

  • Access the personal data we hold about you
  • Request correction of inaccurate data
  • Request deletion of your data (subject to legal retention requirements)
  • Opt out of non-essential data collection

8. Children’s Privacy

The Service is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children.
